How I can Register a Rent Deed in Pakistan?

In Pakistan, every person who offers their immovable property for temporary occupation or let out to a tenant is required to execute a tenancy agreement (also commonly known as a “Rent Deed”). Rent laws are covered under a provincial domain, which means that the provincial government makes laws pertaining to rent matters. In Punjab, the Government of Punjab has promulgated THE PUNJAB RENTAL PREMISES ACT 2009, which covers and regulates all affairs pertaining to rent.

STEP 1: REPORT FROM REPUTABLE SPECIALIST REGARDING HEALTH OF CHILD

Rent Deed must be in writing and registered?

As required by section 5 of the Punjab Rental Premises Act 2009, every rent/tenancy agreement must be in writing and registered with the Rent Registrar under the Registration Act, 1908. The Rent Registrar will then enter the particulars of the rent/tenancy in a register, affix his official seal on the tenancy agreement, retain a copy thereof, and return the original agreement to the landlord. The tenancy agreement entered into between a landlord and tenant must be registered with the Rent Registrar in order to be valid. Any other agreements made between the two parties regarding the property must also be presented to the Rent Registrar for approval.

STEP 2: PREPARE CHILD ADOPTION CONTRACT

What particulars are required to be described in the Rent Agreement?

The Rent Agreement or Tenancy Agreement for the purpose of registration must contain all necessary particulars of both the Landlord and the Tenant, amongst other things. The particulars which are necessary and required to be detailed in the Rent Agreement are as follows:
- The names and contact details of both the Landlord and the Tenant
- The address of the property being rented
- The rental amount and frequency of payment
- The length of the tenancy agreement

STEP 3: OBTAIN GUARDIANSHIP CERTIFICATE FROM COURT

Who is a Rent Controller?

Rent Controller is a Sub-Registrar of the area in which property is located. Sub-Registrar registers Rent Agreement under Section 17(d) of the Registration Act, 1908 and Section 107 of the Transfer of Property Act, 1882

What are the Disadvantages for not Registering Rent Deed or Tenancy Agreement?

Any disputes in relation to rent are to be handled and decided by the Rent Tribunal - which is a court that specializes in dealing with such cases. According to Section 9 of the Punjab Rental Premises Act 2009, any applications related to a rent agreement will not be accepted unless the agreement itself is registered with the Rent Controller. If the application is submitted by the Tenant, their case will not be looked into unless they also deposit 5% of the annual rent into the Government Treasury. The Pakistani government requires that landlords wishing to file for rent control must first deposit 10% of the annual rent with the Treasury.

FAQs

To register a rent deed in Pakistan, you should start by drafting a rent agreement with mutually agreed terms between the landlord and the tenant. This deed should include details like rent amount, duration, renewal terms, and maintenance responsibilities. Once both parties sign, take the deed to the local sub-registrar office where the property is located. Both the landlord and tenant need to appear at the registrar’s office with two witnesses, CNICs (ID cards), passport-size photographs, and the original deed. The registrar will officially stamp and register the deed, making it legally binding.

Yes, in Pakistan, it is mandatory to register a rent deed if the tenancy duration is longer than 11 months, or in cases where provincial laws require registration, such as in Punjab under the Punjab Rented Premises Act. Registering the deed provides legal security for both landlord and tenant and ensures that the tenancy terms are enforceable in court if needed.

You will need the following documents to register a rent deed:
The original rent deed (rent agreement) signed by both parties.
Copies of CNICs (Computerized National Identity Cards) of both landlord and tenant.
Two recent passport-size photographs of both the landlord and tenant.
CNIC copies of two witnesses.
Proof of ownership or authority of the landlord to lease the property. The sub-registrar will verify these documents and proceed with the registration.

The cost of registering a rent deed in Pakistan varies by region, as each province may have its own registration fees. Generally, registration fees are a small percentage of the annual rent, along with additional stamp duty charges. Check with your local sub-registrar’s office for the exact fees applicable in your area.

Typically, rent deed registration in Pakistan can be completed within a few hours if all required documents are in order and both parties are present. However, it may take a few days in some cases if there is a backlog at the registrar’s office.

As of now, most areas in Pakistan still require physical appearance at the sub-registrar’s office to register a rent deed. However, in some cities like Lahore and Karachi, digital records and online portals are gradually being introduced for document submission and tracking, though the registration process itself remains offline.

If a rent deed is not registered, it may be difficult to enforce the terms legally in case of disputes. Unregistered deeds might not be accepted as valid evidence in court, and both parties could lose legal protection under tenancy laws.
