A Pakistani Muslim wife cannot divorce her husband under the laws of Pakistan unless she has the delegated power of pronouncing divorce given to her by him in Nikahnama. In that case, the Wife can issue a divorce to the husband by following the proper procedure which is mentioned below. The only difference is that instead of the husband, the wife shall execute the divorce and file an application with the Chairman Union Council for issuance of a Divorce Effectiveness Certificate.
If the wife wants to dissolve the marriage and live separately from her husband, she can file a Suit for Dissolution of Marriage on the Principle of Khula. Khula is an Islamic right available to the Wife to seek dissolution of her marriage if the husband refuses to divorce her. Nowadays, the procedure of filing khula in court has been simplified. All a Wife needs to do is to hire a competent lawyer and provide him with all the details and documents necessary for preparing a case. The wife must appear once in court to make a statement, after which the decree of khula will be ordered by the Family court.
